WAIVER AND RELEASE OF LIABILITY 

IN CONSIDERATION OF the risk of injury that exists while participating in SALES OF TEA PRODUCTS AND ACCESSORIES (hereinafter the "Activity"); and 

IN CONSIDERATION OF desire to participate in said Activity and being given the right to participate in same; 

YOU (THE CONSUMER) HEREBY, knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or cause of action of any kind arising out of your participation in the Activity; and 

YOU (THE CONSUMER) HEREBY release and forever discharge SIP OF SERENITEA LLC, located at 5425 Peachtree Parkway NW Peachtree Corners, Georgia 30092, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively "Releasees"), from any physical or psychological injury that you may suffer as a direct result of your participation in the aforementioned Activity.

YOU (THE CONSUMER) voluntarily participating in the aforementioned activity and you are participating in the activity entirely at your own risk. You are aware of the risks associated with participating in this activity, which may include, but are not limited to: Physical or Psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. You understand that these injuries or outcomes may arise from your own or others' negligence, conditions at the activity location(s). Nonetheless, you assume all related risks, both known and unknown to you, of your participation in this activity. 

YOU (THE CONSUMER) FURTHER AGREE to indemnify, defend and hold harmless Sip of SereniTEA LLC against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by you or anyone on behalf, including attorney's fees and any related costs.

YOU (THE CONSUMER) FURTHER ACKNOWLEDGE that Sip of SereniTEA LLC is not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Sip of SereniTEA LLC. In the event that you should require medical care or treatment, you agree to assume all cost involved and agree to be financially responsible for any costs incurred as a result of such treatment. You are aware and understand that you should carry your own health insurance. 

BY PROCEEDING WITH PURCHASES, YOU HEREBY ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. YOU  EXPRESSLY AGREE TO RELEAS AND  DISCHARGE Sip of SereniTEA LLC AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNENYS, STAFF, VOLUNTEERS,  HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND YOU AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT YOU OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST Sip of SereniTEA LLC FOR PERSONAL INJURY OR PROPERTY DAMAGE.

To the extent that statute or case law does not prohibit release for ordinary negligence, this release is also for such negligence on the part of Sip of SereniTEA LLC, its agents, and employees. 

This Release shall be governed for all purposes by Georgia law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements. 

This waiver and release of liability shall remain in effect for the duration of your participation in the activity, during this initial and all subsequent events of participation. 

YOU (THE CONSUMER), affirm that you are of the age of 18 years or older and that you freely agree with all terms in this release of liability agreement.  You certify that you have read this agreement, that you fully understand its content and that this release cannot be modified orally. You are aware that this is a release of liability and a contract and that you agree by your own free will when making purchases of any products associated with Sip of SereniTEA LLC.
